Terms of Service
These Terms of Service ("Terms") govern your access to and use of Transend ("Service"), operated by Transend ("we"). By creating an account or using the Service, you agree to these Terms.
1. The service
Transend provides an API and dashboard for sending transactional email. The Service is intended for developers and businesses who need to deliver programmatic email — account notifications, OTPs, receipts, and similar — to their own users.
2. Acceptable use
Your use of the Service is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference. Violating that policy is a violation of these Terms and may result in immediate account suspension.
3. Account registration
You must provide accurate information when creating an account. You are responsible for all activity that occurs under your account and for keeping your API keys secure. If you believe your account has been compromised, contact us immediately at hi@transend.email.
4. Payment and billing
Paid plans are billed in advance on a monthly or yearly cycle. Overage charges are billed at the end of each billing period. We will email you before any price changes take effect. We do not charge for usage you did not incur, and we do not make retroactive changes to your bill without notice.
Refunds are issued at our discretion for unused service. We do not issue refunds for accounts suspended due to policy violations.
5. Service availability
We operate the Service with reasonable care and aim for high availability, but we do not guarantee uninterrupted service. We publish real-time status at status.transend.email.
6. Data and privacy
Our handling of personal data is described in our Privacy Policy. By using the Service, you agree to that policy.
You retain ownership of your data. We do not use the content of the emails you send for any purpose other than delivering them and detecting abuse.
7. Intellectual property
The Transend name, logo, and software are our property. Your use of the Service does not grant you any rights to our intellectual property. We do not claim any ownership over the content of the emails you send.
8. Termination
You may cancel your account at any time from the dashboard. We may suspend or terminate accounts that violate these Terms, with or without notice depending on the severity of the violation.
On termination, we retain your data for the periods described in the Privacy Policy and then delete it.
9. Limitation of liability
To the maximum extent permitted by law, Transend is not liable for indirect, incidental, special, or consequential damages arising from your use of the Service, including lost revenue, lost data, or business interruption. Our total liability for any claim is limited to the amount you paid us in the 3 months preceding the claim.
10. Changes to these Terms
We will email you at least 14 days before making material changes to these Terms. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
